3. Eligibility and Admission

  • Are committed to maintaining sobriety and following our program
  • Meet our screening and admission criteria
  • Agree to follow all house rules and program requirements
  • Complete our admission process and required documentation

  • Payment is due as specified in your service agreement
  • We accept various payment methods including cash, check, credit/card, and insurance
  • Insurance coverage varies; you are responsible for verifying your benefits
  • You are responsible for all charges not covered by insurance

Important:

  • Failure to pay may result in termination of services
  • Outstanding balances may be sent to collections
  • You may be responsible for collection costs and legal fees

6.2 Insurance and Third-Party Payment

If you are using insurance or third-party payment:

  • You authorize us to bill your insurance company
  • You authorize us to release necessary information for payment purposes
  • You are responsible for verifying your coverage and benefits
  • You are responsible for any deductibles, co-payments, or non-covered services
  • You must notify us of any changes to your insurance coverage

6.3 Refund Policy

Refund policies are specified in individual service agreements and may vary based on:

  • Length of stay
  • Reason for discharge
  • Services provided
  • Notice given
  • Circumstances of departure

Please review your service agreement for specific refund terms. Refund requests should be submitted in writing to our administrative office.


7. House Rules and Program Requirements

7.1 Resident Responsibilities

Residents are expected to:

  • Maintain sobriety and abstain from all substances
  • Attend required meetings and programming
  • Submit to drug and alcohol testing as required
  • Follow all house rules and community standards
  • Treat staff, other residents, and property with respect
  • Maintain personal hygiene and cleanliness
  • Meet financial obligations on time
  • Participate in assigned chores and responsibilities
  • Follow check-in/check-out and curfew policies

7.2 Prohibited Conduct

The following are strictly prohibited and may result in immediate discharge:

  • Use or possession of alcohol or illegal drugs
  • Violence, threats, or intimidation
  • Weapons or dangerous items
  • Theft or property damage
  • Sexual harassment or inappropriate conduct
  • Bringing unauthorized guests to the facility
  • Violation of others’ privacy or confidentiality
  • Other conduct that threatens safety or program integrity

7.3 Search Policy

To maintain a safe, substance-free environment:

  • We reserve the right to conduct room searches
  • We may search belongings brought onto the premises
  • We may use drug detection methods
  • Searches may be conducted with or without prior notice
  • Refusal to cooperate with searches may result in discharge

8. Limitations of Liability and Disclaimers

8.1 Service Limitations and Disclaimers

No Guaranteed Outcomes:

Steps to Recovery Homes provides supportive housing and recovery services but cannot and does not guarantee:

  • Specific treatment outcomes or results
  • Successful recovery or continued sobriety
  • Prevention of relapse
  • Any particular result from participation in our programs

Individual Responsibility:

Each resident is ultimately responsible for their own recovery journey. While we provide structure, support, and resources, success depends on individual commitment, effort, and circumstances beyond our control.

8.2 Limitation of Liability

Maximum Liability:

To the maximum extent permitted by Arizona law, our total liability to you for any claims arising from or related to our services is limited to the amount you have paid us for services in the six months preceding the claim.

Excluded Damages:

We are not liable for any:

  • Indirect, incidental, or consequential damages
  • Lost profits or lost opportunities
  • Emotional distress (except as required by law)
  • Punitive damages (except as required by law)
  • Damages arising from another resident’s actions
  • Damages from circumstances beyond our reasonable control

8.3 Specific Disclaimers

We Are Not Liable For:

  • Medical emergencies or health complications (unless caused by our negligence)
  • Actions or behaviors of residents or third parties
  • Personal property loss, theft, or damage (except through our negligence)
  • Outcomes of referrals to third-party providers
  • Decisions made by residents regarding their treatment
  • Events or circumstances beyond our control (force majeure)

8.4 Assumption of Risk

By participating in our program, you acknowledge and accept that:

  • Sober living involves personal responsibility and risk
  • Other residents may pose unpredictable risks
  • Complete safety cannot be guaranteed
  • You participate voluntarily and at your own risk

8.5 Indemnification

You agree to indemnify and hold harmless Steps to Recovery Homes, its owners, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of the rights of others
  • Your misconduct or negligence

9. Termination of Services

9.1 Termination by Steps to Recovery Homes

We reserve the right to terminate services immediately for:

  • Violation of house rules or program requirements
  • Use of alcohol or illegal substances
  • Behavior that threatens safety or program integrity
  • Violence, threats, or intimidation
  • Non-payment of fees (after appropriate notice)
  • Failure to comply with treatment recommendations
  • Any reason specified in your service agreement
  • Any reason permitted under Arizona law

Notice:

  • We will provide written notice when possible
  • In emergency situations, immediate termination may occur
  • You will be provided with appropriate discharge planning when possible

9.2 Termination by Resident

You may choose to leave our program by:

  • Providing advance notice as specified in your service agreement (typically 7-14 days)
  • Completing discharge planning with staff
  • Settling all financial obligations
  • Following proper check-out procedures

Note: Failure to provide proper notice may affect your eligibility for refunds and future readmission.

9.3 Effects of Termination

Upon termination:

  • You must vacate the premises by the specified date
  • All personal belongings must be removed
  • All financial obligations remain due
  • We will close your file and prepare discharge documentation
  • Your information remains protected under our Privacy Policy

10. Compliance and Legal Framework

10.1 Regulatory Compliance

Steps to Recovery Homes operates in compliance with:

Arizona State Regulations:

  • Arizona Department of Health Services licensing requirements
  • Arizona Revised Statutes governing behavioral health residential facilities
  • Local zoning and housing regulations
  • Building and fire safety codes

Federal Regulations:

  • HIPAA Privacy and Security Rules
  • 42 CFR Part 2 (Substance Abuse Confidentiality)
  • Americans with Disabilities Act (ADA)
  • Fair Housing Act
  • Other applicable federal requirements

10.2 Mandatory Reporting Obligations

As required by Arizona law (A.R.S. § 13-3620), we must report:

  • Suspected child abuse or neglect
  • Suspected abuse, neglect, or exploitation of vulnerable adults
  • Certain communicable diseases to public health authorities
  • As otherwise required by law

These reporting obligations may require disclosure of protected health information as permitted by law.

10.3 Cooperation with Authorities

We cooperate with lawful requests from:

  • Law enforcement (as permitted by law and 42 CFR Part 2)
  • Courts (in response to valid court orders)
  • Regulatory and licensing agencies
  • Other authorities as required by law

All disclosures are made in accordance with applicable confidentiality laws.


11. Dispute Resolution

11.1 Governing Law

These Terms and Conditions are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Arizona.

11.2 Internal Complaint Process

Before pursuing external remedies, we encourage you to use our internal complaint process:

Step 1: Submit a written complaint to our administrative staff
Step 2: We will investigate and respond within 10 business days
Step 3: If unresolved, you may request review by senior management
Step 4: Final decision will be provided within 30 days

11.3 Mediation

If disputes cannot be resolved through our internal process, we encourage mediation through a neutral third party before pursuing litigation. Mediation costs will be shared equally unless otherwise agreed.

11.4 Arbitration

Certain disputes may be subject to binding arbitration as specified in individual service agreements. Arbitration will be conducted under the rules of the American Arbitration Association in accordance with Arizona law.

11.5 Class Action Waiver

To the extent permitted by law, you agree to bring claims against us only in your individual capacity and not as part of any class or representative action.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any individual service agreements, constitute the entire agreement between you and Steps to Recovery Homes regarding use of our website and services.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

13.5 Survival

Provisions that by their nature should survive termination (including limitations of liability, indemnification, dispute resolution, and confidentiality obligations) will survive termination of these Terms.

13.6 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

13.7 Interpretation

  • Section headings are for convenience only and do not affect interpretation
  • “Including” means “including but not limited to”
  • Singular includes plural and vice versa
  • “Or” is not exclusive unless context requires otherwise

14. Changes to These Terms

14.1 Right to Modify

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective when posted on our website with an updated “Last Updated” date.
